Court Grants Emefiele’s Request for Forensic Review of Electronic Evidence( WhatsApp Chats & IPhone 12) in Ongoing Criminal Charge

In a significant development before the High Court of Lagos State in Ikeja, Lagos, the Court has granted the request of the Olalekan Ojo SAN lead counsel to the defendant, former CBN Governor Godwin Emefiele, for an independent forensic review of WhatsApp chats and a mobile device (Exhibit E, iPhone 12) tendered by the prosecution.

This ruling carries weight not just for the ongoing matter but also for the wider administration of criminal justice in Nigeria.

Key Points from the Court’s Decision:

  • The defence has been granted leave to engage independent forensic experts to examine the WhatsApp conversations and verify the authenticity of Exhibit E.
  • The integrity of the chain of custody will be maintained as the iPhone remains in the Court’s custody, ensuring the security and credibility of the evidence.
  • The review is to be conducted transparently in the presence of representatives of the prosecution, the defence, and the court’s registrar, with strict safeguards in place.
  • The forensic examination is scheduled for 24th & 26th September 2025, between 10am and 2pm, with the trial further adjourned to 7th, 8th & 9th October 2025.

Why This Matters:

This decision reflects the Nigerian judiciary’s recognition of:

  • The right to a fair trial, which includes not only access to evidence but the right to independently scrutinize evidence and test its authenticity.
  • The importance of forensic science and technology in modern trials, especially in cases where digital evidence plays a critical role.
  • The principle that justice must not only be done but must be seen to be done—through openness, transparency, and respect for due process.

This moment underscores the centrality of meticulous legal advocacy in defending clients’ rights, challenging procedural irregularities, and ensuring that the evidentiary process stands the test of scrutiny.

As technology increasingly intersects with the law, this case also highlights the growing need for Nigerian jurisprudence to continuously evolve in step with global best practices on digital evidence.

We remain steadfast in our commitment to:

  • Upholding the constitutional guarantees of every citizen.
  • Advocating for justice rooted in fairness and evidence-based proceedings.
  • Ensuring that the courts continue to serve as a bulwark of rights, liberty, and integrity.

This ruling is more than a procedural victory, it is a reaffirmation of the values that keep our justice system credible and trustworthy.
